3M Reaches Major Combat Arms Settlement With Over 99% Participation Rate
3M Co. has achieved a significant milestone in its combat arms settlement, with participation exceeding expectations as the final registration deadline closed. The company disclosed that more than 249,000 out of approximately 293,000 eligible claimants have registered to participate in the resolution agreement. An additional 41,000+ claims were dismissed through court proceedings, positioning the overall participation rate to exceed 99.9% once all pending registrations are processed and validated.
Participation Milestone: A Strong Foundation for Resolution
The exceptional enrollment rate for the combat arms settlement reflects strong support from claimants. This nearly universal participation strengthens the legal foundation of the agreement and demonstrates broad acceptance of the settlement terms among those impacted. With such comprehensive participation, the resolution is poised to move forward with minimal complications or additional legal challenges.
Payment Structure and Financial Commitments
Under the combat arms settlement framework, 3M commits to distributing up to $6.0 billion across the settlement period spanning 2023 through 2029. This payment schedule translates to a present value of $5.3 billion on a pre-tax basis, for which 3M has already established financial reserves. The extended payment timeline allows the company to manage the financial impact while fulfilling its settlement obligations to claimants.
Insurance Recovery and Offset Strategies
Recognizing the substantial settlement costs, 3M and its subsidiary Aearo are actively pursuing insurance recovery claims to offset a portion of the payments. These recovery efforts include formal proceedings through a Delaware-based lawsuit and concurrent arbitration processes. By pursuing third-party insurance coverage, the companies aim to reduce the net financial burden of the combat arms settlement on their operations.
