The trial is approaching with increased tension, OpenAI demands an investigation into Musk's "violations and anti-competitive behavior."

OpenAI issues a week-of notice to the Attorneys General of California and Delaware, urging an investigation into Elon Musk and his associates’ “violations and anticompetitive conduct.” A highly watched trial between the two sides is set to begin soon.

In the letter, OpenAI strategy chief Jason Kwon alleges that Musk has been trying to undermine OpenAI through various “attack” tactics, including “coordinating actions” with Meta CEO Mark Zuckerberg.

Musk and OpenAI CEO Sam Altman previously co-founded OpenAI in 2015 with multiple researchers and executives, at which time it was a nonprofit organization. In 2018, Musk left after failing to persuade company executives to merge OpenAI with Tesla. Since then, he has founded xAI, and starting in 2024, he has sued OpenAI, claiming that he was “carefully manipulated” and “deceived” as he explored the company’s transition to a for-profit entity.

Jury selection for this trial is expected to begin on April 27 at the U.S. District Court for the Northern District of California.

In the letter, Kwon says Musk’s actions could hinder OpenAI’s efforts to advance general artificial intelligence (AGI). Kwon wrote:

“The purpose of these attacks is to strip from those who are legally required to ensure that AGI benefits all of humanity control over AGI’s future, and transfer it to rival competitors who lack mission-driven principles and also refuse to take responsibility for safety.”

OpenAI has previously expressed similar concerns. In January of this year, the company sent a letter to investors and banking partners, warning that as Musk’s lawsuit against the AI lab moves into the trial phase, it expects him to make “deliberately exaggerated, attention-grabbing remarks.”

In that letter, OpenAI said Musk is likely to make some “unrealistic” statements, which “are part of the harassment tactics he has used in the past.”
